Terms of Service

First draft. These terms have not yet been reviewed by counsel. They reflect our intent and will be tightened before Tandem is opened to the public. If any clause conflicts with applicable law, that law takes precedence.

1. Who we are

Tandem ("Tandem," "we," "us") is a communication platform operated by Consolidus Operations LLC, an Ohio limited liability company, from Akron, Ohio. "You" means the individual or organization using Tandem under these terms. When you create a Tandem handle (a @tandem-cc.com address), you're agreeing to these terms.

2. Your handle and account

Each handle represents a hybrid entity: you, plus the AI assistant (Claude or another model) you work with. Handles are personal and non-transferable. You're responsible for what's sent from your handle, whether drafted by you directly or drafted by your AI on your behalf. The human-signs step is the product.

You may pick any handle that isn't already taken, isn't on our reserved list (brand terms, roles like admin, etc.), and doesn't impersonate another person or trademark. We may reclaim handles that violate these rules.

4. Your messages

You own what you send. We don't claim copyright in your messages. We store them to deliver them and to make them accessible to you and the people you sent them to. We don't use your message content to train machine-learning models, and we don't sell it.

Messages drafted by your AI and signed by you are treated as your messages for every purpose: authorship, accountability, rights, obligations. The provenance line in every message (drafted by claude · signed by you · via tandem_api) is metadata, not a liability shift.

5. Our service

Tandem is provided on an "as is" and "as available" basis during preview and pre-launch. We aim for reliability but we make no uptime or delivery-time guarantees while the platform is under active development. Messages routed through third-party transports (email via Postmark, your AI provider's MCP infrastructure, etc.) are subject to those providers' own terms.

6. Security

We require two-factor authentication on every Tandem account, and we support passkeys (Face ID, Touch ID, Windows Hello, hardware keys). We don't store account passwords. There are no passwords to steal. If your authenticator is lost or compromised, contact us to recover access.

7. Termination

You may delete your handle at any time. We may suspend or terminate a handle for violations of these terms. Deleted handles may be reclaimed after a reasonable cooling-off period.

8. Disclaimers

Tandem is provided without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the service will be uninterrupted, error-free, or secure against every conceivable threat, nor that any message will arrive within any specific time.

9. Limitation of liability

To the extent permitted by law, Tandem and its operators are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Our aggregate liability for any claim arising from these terms or your use of Tandem is capped at the greater of $100 or the amount you've paid us in the preceding 12 months.

10. Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute arising under these terms will be brought in the state or federal courts located in Summit County, Ohio.

11. Changes

We may revise these terms. If we make a material change, we'll let you know (a tandem to your handle, at minimum) with a reasonable notice window before the change takes effect.
